Received a Writ with Statement of Claim from bank or lawyer. What should I do next?

I have a accumulated debt from 7 banks (credit cards and personal loans) around RM420,000+. The minimum payment is so high, I seek help from Agensi Kaunseling & Pengurusan Kredit (AKPK) but after servicing for 6 months, I could not afford to service anymore. My appointed officer asked me to withdraw and re-enroll after 6 months. Now its almost 6 months since my last payment to any of AKPK or bank. I received a writ from RHX bank, together with the writ is the Penyata Tuntutan (Statement of Claim). Other banks have not send me anything yet except letter of demand.

This is my 1st time ever receiving such letter and then I googled and landed on this website. Before I post this question I have tried to read the previous similar case posted by someone else. I got to know that I was suppose to present to Kuala Lumpur court on the 8th August from e-kehakiman, thanks to the information I found here. I can’t afford to appoint a lawyer so I decided to appoint myself but honestly I have no idea what I should do and I don’t have knowledge in law.

Question is should I call the plaintiff lawyer or bank to discuss about it, to cancel the writ or court meeting, or should I just go file a memorandum kehadiran? What I should do? I’m scared.

Memorandum yang hendak diturunkan pada Writ

Writ ini tidak boleh disampaikan lebih dari enam bulan kalandar selepas tarikh diatas melainkan jika diperbaharui melaui perintah mahkamah.

Defendan (atau defendan-defendan) boleh hadir bersama dengan mencatatkan kehadiran (atau kehadiran- kehadiran) sama ada sendiri atau melalui peguam di pejabat Pendaftaran Mahkamah.

Seorang Defendan yang hadir sendiri boleh, jika dehendakinya, memasukan kehadirannya melalui pos dan borang borang yang tertentu bolehlah didapati denagn menghantar kiriman Pos berharga RM8 berserta sampul surat beralamat sendiri kepanda Pendaftar, Mahkamah Majistret di Kuala Lumpur.

Pengendorsan hendaklah dibuat pada writ sebelum pengeluaran

Tuntutan plaintif adalah untuk:-

(a) Jumlah sebanyak         RM29,xxx.xx

(b) Caj-caj pembiayaan pada kadar 1.50% sebulan  secara kiraan harian yang dilevikan ke atas baki belum jelas yang masih belum dijelaskan sepenuhnya pada tarikh Bayaran Kena Bayar dari 27 haribulan Jun 2016 sehingga tarikh penyelesaian sepenuhnya; RM*empty

(c) Caj pembayaran lewat pada kadar minima RM10 atau 1% daripada baki tertunggak sehingga jumlah maksima RM100 sekiranya pemegang kad gagal membuat bayaran minima yang kena bayar dari 27 haribulan jun 2016 sehingga tarikh penjelasan sepenuhnya. RM*empty

(d) Kos mahkamah        RM108.00

(e) Kos Asas            RM600.00

Dan RM*empty (atau sekian jumlah sebagaimana yang dibenarkan setelah ditetapkan) untuk kos, dan juga, jika plaintif memperolehi perintah untuk menyampaikan ganti, jumlah wang selanjutnya sebanyak RM*empty (atau sekian jumlah sebagaimana yang dibenarkan setelah ditetapkan.) Sekiranya amaun yang dituntut dan kos dibayar kepada plaintif atau peguamnya dalam tempoh 14 hari selepas penyampaian writ ini (termasuk hari penyampaian) , prosiding seterusnya akan ditangguhkan, tetapi sekiranya ternyata daripada pengendorsan pada writ itu bahawa Plaintif bermastautin diluar wilayah terjadual, sebagaimana yang ditakrifkan oleh Akta Kawalan Pertukaran Wang 1953, atau bertindak mengikut perintah atau bagi pihak seorang yang bermastautin sedemikian, prosidingakan hanya ditangguhkan sekiranya amaun yang dituntut dan kos dibayar ke mahkamah dalam masa yang tersebut itu dan notis pembayaran tersebut diberikan kepada Plaintif atau peguamnya.

Calm down. You are not a criminal. You are not going to jail.

The bank claim you owe them a sum of monies. Now the bank summon you to court to claim it legally.

The first step is to adjudged you as a Judgement Debtor (JD). If you did not attend all the hearing, the bank lawyer will have an easy task of obtaining the Judgement in Default (JID) against you from the court before they can later proceed further to bankruptcy against you.
I have no idea what I should do
Better you file the Notis Kehadiran immediately before the expiry date, within the 14 days from 11th July.

The date 8th August is a Case Management hearing where you meet the Penolong Kanan Pendaftar (PKP), she ask you... '' ada bincang dengan bank?''... sort of questions...

If you want to contest it (or buy a little bit of time) then you tell her that you need time to find a  lawyer and she will sets a date for the next hearing before the Magistrate in an open gallery.

That is roughly what will happen on the 8th August. 

But if you failed to file Notis Kehadiran and did not attend you may be adjudged Judgement in Default (JID) on the other day that you may not know.

I will go and file the Notis Kehadiran tomorrow or latest by day after tomorrow. To file a Notis Kehadiran, I need to go to the Mahkamah Majistret at Jalan Duta?

Can I just copy this and edit a bit and print it out for the filing? I'm sorry if I asked silly question as I read some of them say they will attach a form of Notis Kehadiran for you to fill it up and some of them are saying that you need to type it like the sample I posted above. I got a bit confused. Is it possible that I also postpone the hearing on the 8th of August 2016 to few days later?

Thanks in advance. I have been reading this forum for hours but I'm too stupid to absorb all that I'm reading.

I need to go to the Mahkamah Majistret at Jalan Duta?
As you live in Masai Johor... try to file it in thru Johor Bahru (JB) court.

Only go Jalan Duta, Kuala Lumpur on case management day on 8th August.

Thanks again for the reply. No I live in Kuala Lumpur. I copy that 'bulat-bulat' from one of the tread here which I thought of using it as a sample format. But I will use yours now. Thanks you so much. I will need to seek for your assistant and guidance again after this. Hope you won't find it annoying. 

By the way, is there anything else I should do now beside filing the Notis Kehadiran and wait for the hearing date on the 8th August 2016 at 2pm? And the "bertarikh" in the notice is the date I file in or I put in the hearing date?

You edit/type and print it or if they already provide standard form, better still, just fill it up and file.

Is it possible that I also postpone the hearing on the 8th of August 2016 to few days later?
As you are still not familiar with court procedures yet better not postpone it.

Attend it and at the case management you may ask Penolong Kanan Pendaftar (PKP) the possibility or how to transfer your case to Johor Bahru.

and the "bertarikh" in the notis is the date I file in or I put in the hearing date?

Noted with many many thanks. By the way, the bank officer just called me and offered me a plan and asked me to pay a certain amount before the 25th July 2016, they will cancel the writ. They just ask me to pay it or no choice will have to proceed with the court.

This is a good option for you. So you negotiate it out with the bank towards the best option and to avoid being adjudged a debtor.

Since they have already file the summon in courts against you,  better you still file the Notis Kehadiran, just in case...''no choice will have to proceed with the court.''
