Hi,
I need help.
I am middle of applying divorce with my ex-husband. However, the case is still pending.
Recently, I found out that I am pregnant and the child is belong to my boyfriend.
My questions are:
1. If my divorce case has not settled, can my boyfriend listed as the baby's father?
2. Is there any problem if I deliver baby oversea to get the citizenship from that country and back to Malaysia? (I am Malaysian) What are the countries allow me to do so?
Awaiting constructive answer. Thank you!

Can.
Boyfriend must be present during registration and say that he is the father.

Thank you for the answer.
But what if the authority request for marriage proof?
According to Malaysia law, a woman cannot re-marry if her divorce case is not settled. Thus, I can't show my marriage proof as my divorce case is pending.

@ Cindy

middle of applying divorce with my ex-husband
my divorce case is pending.
What type of application is pending?
Is it a Single Petition, Mutual(Joint) Petition or Contested Petition.

As vkpc has pointed out that it is possible to register the child with the father's name in it.

Just take note that in the last High Court Divorce proceeding, both the parties have to be in front of the Divorce Judge, and if it is a contested divorce, possible complications can occur, you being the party "more" responsible for the breakdown of the marriage. If there are alimony and assets distribution seek, you are the "disadvantaged" party. So, make sure that your timing is appropriate. Do not carry the bloated stomach into the the High Court of which the other party lawyers can find more faults.
