Hello, I have a situation and I am not sure how to approach this matter. I have done my research but could not find anything to help me thus far.

My husband was admitted in the hospital a few years ago and had to undergo an operation and we used insurance to pay. Once the operation was over, the hospital told me to pay and they said that the insurance does not cover the operation. I did not call the insurance company to check. I could not pay as I didn't have enough money. The hospital then sued me and I had to go back and forth to the court several times. I also asked the hospital for discount and they gave me some discount. Still, I did not have enough money to pay. So I had some help from a friend and my friend called the insurance company. When he called the insurance company, the insurance company said they do cover the expenses for the operation and after that, they paid the hospital and the matter was settled.

What I want to know now is, do I have any right to sue the hospital for the hardship they put me through i.e. going back and forth to the hospital, to the court and also the embarrassment that I faced? I admit that it was my fault for not checking with the insurance company earlier on, but I would just like to know if I do have any grounds to sue the hospital for putting me through such trouble.

Hope anyone can help me. Thank you.

What was the final court verdict?

Dear Mike,

Thank you for your response. There was no court verdict as the case was dropped by the hospital when the insurance has paid them.

You should have asked for cost when they pull out the case from the court.

When he called the insurance company, the insurance company said they do cover the expenses for the operation and after that, they paid the hospital and the matter was settled.
To me the hospital is not at fault because they are not getting paid that they decide to sue. It seems to me it is  the insurance company that are causing you the trouble.

But then, finally..

I admit that it was my fault for not checking with the insurance company earlier on,
You sincerely admitted that it was out of your own fault for not checking it with the insurance company.

I suggest you move on and take it positively that your husband got his much needed treatment and has recovered well.
