How I set aside Receiving Order and Adjudication Order (AORO) without a lawyer

Ingat tak saya pernah post dekat sini cari lawyer untuk wakil saya set aside AORO?

Alhamdulillah saya berjaya set aside sendiri pada bulan April tadi. Tanpa lawyer, tanpe legal aid. Saya buat semua sendiri based on bacaan online dan bacaan di Lawyerment. Based on advise kawan lawyer, bank ada mistake on technicality sebab tertinggal hantar surat ke alamat saya yang terkini semasa stage creditor petition and I argued on that. So bank choose to plea no contest and minta bayar tunggakan sahaja. And now 4 months after I filed the case, I'm free again and no more bankrupt.

Saya bermula sama macam lawyer-lawyer lain dengan buat sendiri paper saman dalam kamar dan affidavit sokongan. Failkan di Mahkamah Tinggi Shah Alam. Tunggu tarikh pendaftar. Depan pendaftar, permohonan ditolak. So lawyer bank macam act sikit. Despite that, saya failkan semula untuk bicara depan hakim untuk set aside AORO. Semasa tarikh depan majistret bank choose to plea no contest and minta bayar tunggakan sahaja. Dalam satu bulan saya setelkan tunggakan melalui Jabatan Insolvensi. Kemudian saya dapat 1 tarikh depan hakim. Insolvensi came on that day to tell hakim yang saya sudah bayar tunggakan around RM88,000++. Hakim jatuhkan untuk batalkan AORO.

Senang sahaja. Yang penting you all jangan give up bila dijatuhkan bankrup. Try to appeal ya. Good luck!

Hanya satu, tidak semua ada kelebihan mempunyai wang sebanyak yang kamu ada ketika ia amat diperlukan. Terdapat kes di mana rayuan tidak dapat di failkan ke Mahkamah Rayuan Putrajaya kerana tidak punya cukup wang untuk ke sana walaupun peluang memihak kepada nya sudah meningkat ke lima puluh peratus.

By virtue of your previous postings, either:

1. You have studied Laws before
or
2. You have very closed friends who are practicing lawyers now

You could be even a lawyer in the commercial sector.

Your fighting spirits is admirable. Thanks for sharing again.

Yes, I studied law before but never practise.
Yes, I have friends but the only one I consulted is my Senior in the field.
I hope that none of my close friends know what I dealt before. You know some people are judgemental. Hehe!

I hope my case can inspired others. 

Thanks Lawyerment. My case mostly 60% followed from previous post and notes in Lawyerment. You guys do good stuff here. We can learn many things here.

Thanks Mike.. Its actually around RM8,888 for the tunggakan dengan bank from the whole RM50,000 sum. Tapi Bank memang dah dapat payment ini sebab dia cut from my saving masa freeze account the other day.

But actually it wasn't that expensive to file the case. I'm lucky that I can do it on my own. One law firm in KL want to charge me RM3,000 just to file. 

I think the costs from filing on December 2015 up till April 2016 around RM300.

Alhamdulillah.. tuah dan bernasib baik memihak saya. Harap tiada yang lain menghadapi masalah yang sukar untuk set aside bankruptcy. Saya faham the struggle.

Yes, filing costs are not expensive. The most expensive probably is the Certificate of Urgency (RM80 here in High Court of Shah Alam, Selangor). That's why I would encourage people to discharge without lawyers especially when you have paid off your debt completely.

No need to fork another RM1,000 just to get lawyers to attend on your behalf at the court for 10 minutes.
