Hi, I am working in a private company for the past 1 year. I did not get my confirmation letter after 6 months of probation. And, only in my 13 month the company MD verbally confirmed us (they were few of us) saying that if we have exceeded 6 months then we are automatically confirmed. 1) Is there such thing? We have not signed any confirmation letter as per to date. Since the time i started working, my EPF nor SOCSO has been credited to my account but salary has been deducted for both. We do not get our pay slip as well and thats because the salary credited into our account and salary quoted by HR in our branch is not the same. It is always lesser than what is quoted by our HR here. We have no idea what is the salary being credited and what is the deduction being done from the headquarters (we are a branch in a different state apparently). If I would like to resign can I give a 24 hour resignation or it has to be 3 months according to the Employee Handbook for confirmed staffs? (I am not sure of my status as I have not signed any letter).

What is the termination period stated in your appointment letter?

Any confirmation of permanent staff should be in writing.

Why give 24 hours resignation?

If i were you, I would consider claiming constructive dismissal as non payment of EPF and SOCSO is a fundamental breach which would entitled you to terminate the contract and file a complaint at the Industrial Relations Department within 60 days after you had send the letter of constructive dismissal.
