Default Creditcard payment

Hi all,

Recently i got a few call from a debt collector claimed that i owe hong leong credit card total rm36.8k (include interest). funny part is from the first call from them, they said i owe rm27k and after 1-2 weeks on 12th of may they said my total amount is 36.8k (10k different!!) and offer if i do full settlement it would be rm25k.

Frankly i defaulted it for very long time..i didnt make a single payment to it since apr/may 2009. and i went to bank negara and check my ccris, is was clean. and i check on my insolvency, i m not bankrupt either.

so my question is, can they file bankruptcy on me? Please advise.

but i didnt/dont think receive any letter from the lawyer. just call from the debt collector.

never never deal with bill collectors directly unless together in the presence of the bank lawyers..

For your CASE
Pay even RM10.. you would have dug a big hole to bury yourself like an ostrich... Do not contact the bank or even the bill collectors.. Wait and see if there are any "saman" from the COURT or legal letters.

Study Azyek case carefully.. and then please ask HIM..!! He is just a 4 hour survivor from a fight with banks.

Funny though, Ayzek and I was having a post mortem about his case over lunch and we were talking about another nasty bank, HLBB and out pop this bank name..!! Siapa hantu..??

yea, i actually read a few post and said not to pay anything plus my is over 6yrs (from apr 2009 till now).

i tried to read ayzek's case but i am still bit blur/confuse with it..need sometime to digest.

i have a concern, i moved to kl and my hometown address is no longer use..so i dont really know if i receive any letter or saman. is there anyway to check it?

There are ways to check.. you have not read enough postings. When I start I read almost 1,000 postings and replies backwards.. and this is my NO.671 posting.. buy 8671 this sat.. hahahaa..

Your details of your debts is too scant even to give proper opinions. Write like Azyek and you would be free from bill collectors temporary.!! Your 6 years may not be "just over yet".. Evasive actions may be required.

can i contact the bank to find out more about the debt? i consider 'safe' as long as i dont make any payment,right?

@ayzek do u know how can i check out if i have any saman? or perhaps can u share with me ur wechat id?

Do not contact the bank or even the bill collectors
Repeat..
However, if you want to commit suicide, no one here is stopping you.

Contact the bank only if you have a plan on how to repay them, if not, any written correspondences will VOID the 6 years limitaion act.!! Reset the clock..!!

Why didnt u approach AKPK..??

well, thats the only details that i got from the debt collector.

i received an email from my payroll company, the debt collector company sent a letter (letter date 30th march 2015) to them and they forward to me. and there is not amount stated in the letter except credit card account/number. so i called up to the debt company and speak to them once, but we didnt talk much, due is late friday evening (i guess she want to go back and lazy to layan) so she said will contact me back, i said ok..but after that no call, or maybe there is but i didnt pick up. untill few days ago i answered the call, saying that i own 27k and 2nd time she tell i owe 36.8k. and i said i dont have such money to pay and if i can clear, i have around 4-6k for settlement..and suddenly she asked me to call to HLBB creditcard department to nego with the manager.

so to recap, i memang defaulted the cc payment, and i receive 1-2 letter from a lawyer firm for asking to pay, ad i choose to ignore it. all this happen in my home town and i've moved to kl for about 4-5yrs. i know i dont have much information, but thats all i got.

so if i not to call to the bank, then i have no idea where else can i find more info about it

This is just a call from the bill collectors. They will keep on doing this as long as our name is still in the list. Our name is in the list because we have debt. And you know your debt better than anybody else. Among the harrasmaent i have to cope in the past is .. they sent an indian boy to my house. So just ignore the calls from bill collectors they may trick into paying a small amount and your limitation period may not be effective defense later. Settle it thru legal way.

This is a good news. Definately you are still clean. Please confirm the time when you start to default and try to find old documents ready if bank try to do it before the 6th year comes to an end.

Yes they can file bankruptcy but before the do that they have summon and make you a judgement debtor first. Not so immediate. Some procedure they have to thru first. That may take about 6 months.

Its best you post all your questions here first . I may not have all the answer but  other forumers may have it..

i cant remember the time and i cant find the lawyer letter as i shifted a few times

i shifted a few places and my hometown house already auctioned out plus i seldom go back to my hometown.

1 thing i got curious is how the debt company can send letter to my payroll company, how they find out?
