Hi Aurora,
Now comes hard part, to win again at the full trial.
Please prepare your defense and post it here for checking.
You don't have much time left, and pls don't do things last minute again.
Also post the Draft Perintah for your High Court win here, you need it to pressure the bank to give up.

I was at the court filing my deraf perintah and defence and i saw a man with his friend passing me by with a piece of paper in his hand. I bet its a Notis Kehadiran. I first wrote to this forum about my predicament after i filed my Notis Kehadiran. It was bittersweet - i came this far yet i still feel the jitters every time i enter the court building knowing there are people in that building facing the same problem like me.

Thank you @Notalawyer for your explanation on Go Fishing. Until i read your opinion, I was worrying about 'fishing' for other documentary evidence and the failure to do so - by my own effort or sub poena. We did fish a lot out of the bank - both the documents and their line of defence.

Thank you @Jeff05 for your brief on my case. Abused or not (that was the only cc i had and has been living a cc-less life since 2003 and that i had left the bank acrimoniously), I abhor people (read: lawyers and bankers) who misused the law to achieve their budget/KPI. We are people, not statistics for them to show/tell. PLus, the things those debt collectors did, acting more like Ah Long, riled me up. Personal Data Protection Act should protect us from their abuse, disseminating our private data to our employer/colleagues/etc.

To anyone out there facing similar problem, heres what I advice you to do once you found this forum: -

1. Provide a clear brief of our case so the Sifus could comprehend and respond

2. Share verbatim any correspondence/document sent to us by the plaintiff

3. We are fighting a 'war' - dont be a lazy bum

4. Respond timely to the Sifus' Q and update them

5. Research, research, research (internet can do many great wonders!)

6. Expect many many many visits to the court - filing, attending courts - and the costs that come with it (By now even the guards remember my face and say hi to me )

7. Dont do things last minute (like me) so the Sifus can have ample time to vet our documents or provide their opinion for our next step to do. Plus, there are deadlines to meet in filing the court documents.

8. It's difficult, time consuming and nerve-wrecking. Be strong and persevere. Reconnect with forumers (@Jeff05 never fails to spruce me up)

9. Stay calm in court (I wanted to pick a fight with the magistrate after she turned down my application to set aside the JID because she wont listen to my arguments. Indeed a blessing in disguise, while compiling my rekod rayuan I found the HOLE in documents filed by the plaintiff (false info used in the Notis Ketidakhadiran that support their JID application))

10. It aint over till its over (now that i won my appeal at HC, i have to file for defence at the lower court. A full trial will ensue, if the plaintiff decided to fight me in court). We have come this far. Nothing can stop us.

11. Be grateful, accept critics and help others (i havent dont the helping bit though but i will)

Wrong.. CNY has still got 7 days left. 2morow(9th Day) is NY for Hokkiens. notalawyer, vkpc and i is still waiting for our POMELOS.!!!

Ooops.. did i let the cat out of the baggie....??

FYI... On CNY 15th.Day.. "they" cannot throw any mandarin oranges into any lakes, river, longkang nor attempt to "Fishing" for those orangees up.. But I CAN legally.. Hahahahaa.. Jealous ke?? Jump into the lake together wit me to do more fishing...

Btw.. the hot weather in KL is killing.. If you are planning to chill out at Camerons Highlands, pls take note that "LAVENDAR GARDEN" looks veryvery beautiful from the outside. Wanted to visit it. It took me 25mins to get a parking space but 2.5mins to make a U-turn out. Reason.. Adults RM5, child RM3.. the apex is a 150 metres high uphill and the inclination 40degrees....

You can get Pearl Corn from any night market, like Brinchang night market.

Oooh.. they called it pearl corn ke.. whole family had steamboat nearby b4 going to that pasar malam so no buy extra edible foodstuff.. I bought the bee honey with the honeycomb intact inside.. Bought 2 bottles.. sori no leftovers, inside my stomache oledi..

"Pearl corn".. hehehee.. just brought corn plaster from caring pharmacy to treat corn on his legs...
