Hi Aurora,
Now comes hard part, to win again at the full trial.
Please prepare your defense and post it here for checking.
You don't have much time left, and pls don't do things last minute again.
Also post the Draft Perintah for your High Court win here, you need it to pressure the bank to give up.

1. The Card Member Agreement presented to court in the plaintiff's affidavit of reply to my application to set aside the JID was dated 2006, when a letter from the bank said that the agreement was signed in 2001.
One of the terms of the original agreement is that the bank is allowed to changed to terms anytime they like and you agree to it.  So no issue here.

2. The plaintiff didnt dispute the fact that the last payment was made in June 2004, prior to my resignation from the bank.
Good.
Put more statements where they cannot dispute to establish the "facts of the case".
We need more facts to argue in your submission later on.

3. As i wrote earlier, what triggered their issuance of notice of demand was my complaint letter to bnm on their debt collector and claimed that they are time-barred. do i have any hole here to pursue?
No holes here.

You need to recycle most of the statements from the earlier supporting affidavit as I advised earlier.
I think no need to dispute anything in their statement of claims.
Yes, yes, yes, we agree, all your claims is correct, except that they are Time Barred. Sorry.

The fight is on the Limitation Act. No other way out. Any other excuses is just excuses for this same judge.

There should be "a cause of action" the moment one defaults(the date of last payment). This Judge awarded a JID based on "otoriti" atas. It appears that different Judges views the limitation act "differently". Perhaps if you can have access to some Law libraries that the Judges share positive views on the L.A., would be more advantages. Outquote the banker lowyers with more higher otoriti judgements that supports your cause.

Will be on AL for the next 3 days at Camerons to chill off. If you happened to be there, just post and meet up there.. Cold weather up there now I heard. I love a "Bak Kut Teh" stall at Tanah Merah in front of the bus station. Btw, do u take this dish? No need to ask "him" his fav is curry fish head and he loves to fry snakes head at the courts.....

PEMBELAAN

Pembelaan Am

1. Saya mengatakan bahawa tuntutan plaintif telah dihalang had masa seperti yang digariskan di bawah Seksyen 6(1), Akta Had Masa.

Pembelaan Tertentu

2. Saya mengatakan bahawa: -

a) Tarikh terakhir bayaran ansuran dibuat kepada akaun kad kredit adalah sekitar Jun 2004.

b) Sekitar bulan September 2004, kad kredit defendan telah dibatalkan oleh Plaintif.

c) Plaintif tidak pernah menghantar kad kredit gantian/baru kepada defendan sejak tahun 2004.

3. Saya mengatakan bahawa fakta-fakta di atas tidak dinafikan oleh Plaintif di dalam kertas-kertas kausa berikut yang telah difailkan di Mahkamah oleh Plaintif: -

a) Afidavit Jawapan yang diikrarkan oleh Plaintif pada 30.09.2014  terhadap Notis Permohonan Defendan untuk mengenepikan Penghakiman Ingkar Kehadiran bertarikh 18.09.2014 dan Afidavit Sokongan yang diikrarkan oleh Defendan pada 18.09.2014;

b)  Hujahan Bertulis Plaintif bertarikh 27.10.2014 (untuk Notis Permohonan Defendan untuk mengenepikan Penghakiman Ingkar Kehadiran); dan

c) Hujahan Balas Responden/Plaintif bertarikh 21.01.2015 (untuk Notis Rayuan Perayu/Defendan terhadap keputusan Mahkamah Majistret yang diberi pada 11.11.2014 yang menolak permohonan mengenepikan Penghakiman Ingkar Kehakiman).

4. Saya mengatakan bahawa Notis Penamatan yang dikeluarkan oleh Plaintif pada 07.07.2014 hanyalah satu percubaan untuk menghidupkan semula hutang yang telah lama lupus.

5. Saya mengatakan bahawa dakwaan Plaintif yang had masa berbangkit apabila Plaintif mengeluarkan notis penamatan di atas adalah bercanggah dengan Klausa 20.1(d) Perjanjian Kad Ahli (yang ditanda sebagai Eksibit --- di dalam Afidavit Jawapan Plaintif bertarikh 30.09.2014) yang mengatakan bahawa tiada notis perlu diberikan terlebih dahulu untuk menamatkan Kad Ahli dan penamatan berlaku apabila Ahli Kad mempunyai tunggakan pembayaran.

Also don't bring up anything from the previous affidavits as the defence is starting from scratch again.

Also say that

a. the bank has been sending Credit Card statements which demand payment since 2004 
( look for old statements and keep them in a folder )
b. agents from the bank has been calling and chasing for payment since 2004
c. the credit card account is a normal typical account, nothing special about it
d. plaintiff's claims is time barred since they did not take legal action for more than 6 years

On the statements, they said they sent the statements to my old office address as per my Cardmember agreement and I dont think i can find any even if i were to check at my old office now. But let me try.

My latest draft of defence is as follows: -

2. Defendan mengatakan bahawa: -

a) Defendan sudah tidak menggunakan kad kredit tersebut sejak 2003;

b) Tarikh terakhir bayaran ansuran dibuat kepada akaun kad kredit tersebut adalah sekitar Jun 2004.

c) Sekitar bulan September 2004, kad kredit defendan telah dibatalkan oleh Plaintif, selaras dengan Garis Panduan Bank Negara Malaysia (Classification and Impairment Provisions for Loans/Financing) yang diperlu dipatuhi Plaintif sebagai Bank Komersil.

d) Plaintif tidak pernah menghantar kad kredit gantian/baru kepada defendan sejak tahun 2004.

e) Plaintif terus menghantar penyata kad kredit ke alamat seperti yang tertera di dalam Perjanjian Kad Ahli, menuntut bayaran daripada Defendan sejak 2004.

f) Agen-agen pemungut hutang yang dilantik Plaintif telah beberapa kali menelefon dan mendesak Defendan untuk membuat pembayaran sejak 2004.

g) Akaun kad kredit Defendan adalah akaun kad kredit biasa tanpa sebarang keistimewaan.

3. Defendan mengatakan tuntutan Plaintif kini telah dihalang had masa apabila Plaintif tidak mengambil sebarang tindakan undang-undang dalam tempoh 10 tahun dari tarikh pembayaran terakhir sehingga Jun 2014. 

4. Defendan mengatakan bahawa Notis Penamatan yang dikeluarkan oleh Plaintif pada 07.07.2014 hanyalah satu percubaan untuk menghidupkan semula hutang yang telah lama lupus.
