Cara membuat pengistiharan keluar dari bankrap di Mahkamah Tinggi

Saya telah diisytiharkan bankrap semenjak tahun 2008. Dua minggu yang lalu setelah mendapat pengurangan bayaran dari pihak bank yang membankrapkan saya, saya telah membuat bayaran penuh kepada Jabatan Insolvensi Malaysia (JIM). Saya ingatkan secara otomatik atau dengan bantuan pihak JIM saya akan dilepaskan dari status bankrap, namun rupanya saya perlu membuat sendiri pelepasan ini di Mahkamah Tinggi Shah Alam atau menggunakan pihak lawyer.

Soalan saya, bolehkah saya menguruskan hal ini sendiri di mahkamah dan apakah dokumen-dokumen serta bayaran yang akan dikenakan oleh pihak mahkamah atau jika saya menggunakan khidmat lawyer berapakah fees yang dikenakan ke atas saya?

Encik boleh tanya peguam insolvensi senarai dokumen-dokumen yang perlu difailkan di Mahkamah Tinggi. Salinkan dokumen-dokumen yang kamu telah sediakan di sini untuk diteliti.

Jika awak ada ikut semua peraturan JIM, sepatuh JIM yang keluarkan sijih penegekeluarkan bankrapt kepada awak tak payah melalui application thru High Court. Adakah dulu awak tak ikut pembayaran bulanan mengikut "deed of memorandum" dan sekarang dengan cara discount dari bank bayar satu sekali?. There could be you may have not submited your SOA and JIM does not know whether you may have more "Other Creditors" not declared to JIM in the first instant upon initial reporting. The first basic legal requirement upon adjudged a bankrupt is to report in to JIM within their stipulated timeframe and must go through the "case management" period whether 1-5yrs.

This type of discharge application thru High Court, my personal opinion is to engage a lawyer to protect yourself from other future problems/litigations. Sy tak ada pengalaman harga lawyers fees. Mereka ada lah  Nyamuk Aedes dengan fees mereka.. Sebab itu skrg ada manyak case denggi di sekililing mahkamah2..

Hi jebat dan jeff, terima kasih atas reply tersebut, FYI saya dah bayar ansuran bulan kepada Insolvensi sebanyak RM150 selama 5 tahun bermula dari 2008 sehinggalah Oktober 2014, sehingga baki hutang saya kepada creditor tinggal sebanyak lebih kurang RM20k sahaja. Oleh kerana sudah terlalu lama memegang status bankrap dan menghadkan aktiviti saya, saya telah mencari jalan menyelesaikan baki hutang ditambah dengan fees 11% yang dikenakan JIM terhadap saya. Namun selepas pembayaran dibuat tidak ada langsung seorang pegawai JIM untuk assist saya untuk langkah seterusnya sehingga saya terpaksa bertanya kepada kerani dikaunter JIM tersebut. Saya telah menghadiri mensyuarat antara pihak JIM, saya dan creditor 2 kali dan telah mengistiharkan segala harta yang saya ada pada pihak JIM pada tahun 2009 yang lalu.

Pertanyaan saya apakah dokumen yang saya perlukan untuk dibawa ke mahkamah untuk mendapatkan pelepasan dari status bankrap ini?

The 'kerani' counter could have given you wrong info as usual with certain department. Speak to your ex-OA (Official Assignee). Make an application to JIM and JIM should by right be the one to issue a discharge certificate. I believe, even an application to the High Court, a report from JIM would be required. In others words, you still have go back to your Official Assignee or Jabatan Insolvensi Malaysia (JIM) to get it.

Pertanyaan saya apakah dokumen yang saya perlukan untuk dibawa ke mahkamah untuk mendapatkan pelepasan dari status bankrap ini..
Dapatkan senarai dan contoh dokumen yang perlu difailkan dari peguam JIM. JIM ada memberi perkhidmatan dan nasihat guaman berbayar.

My Official Assignee (OA) advised me to do filling at High Court, I went to Jabatan Pendaftaran Mahkamah Tinggi and they gave me sample of documents to be retype with fix layout. Due to e-filing. The said document is:

a) Saman Dalam Kamar
b) Afidavit Sokongan dan
c) Senarai Eksibit.

Those document need to be filled in accordance to your case storyline especially afidavit sokongan. Please ask for sample of Draf Perintah too, as this is to be submitted through e-filing after hearing.

Afidavit Sokongan and Senarai Eksibit need to endorsed by commissioner of oath. Their service is available at counter. In my case Shah Alam High Court. Within 3 days after e-filing you will received email with extraction Code specifying date for Hearing.

Bring thumbdrive with softcopy as there is a potential mistake in draft perintah and you do not have any idea who will present on behalf of Ketua Pengarah Insolvensi. You can use computer at Library free-of-charge, but they are charging RM1 for every page printed.

It is not difficult, but I suggest to be early as parking lot is limited.

Discharge is fairly easy.

1. File your 'saman dalam kamar' together with the 'affidvit sokongan'
2. Then they will assign a hearing date
3. You will need to serve the 'Summons in Chambers (SIC)' and 'Affidavit in Support (AIS)' to the bank's lawyer
4. Sertakan sekali surat dari Insolvensi dan resit bayaran dalam 'affidavit sokongan'
5. On hearing date just attend, kemudian should there be no problem, the Penolong Kanan Pendaftar (PKP) will grant you order in term
6. Then prepare the 'deraf perintah', send to the bank's lawyer for approval
7. Failkan ke mahkamah and then seal the order.

Cost without lawyer is pretty minimal, tak sampai RM200 pun. Cuma perlu masa dan tenaga. Kalau pakai lawyer mungkin kena keluar lebih RM1K.

For your info, JIM tidak boleh discharge bankrupt. Cuma court yang boleh batalkan perintah penghukuman dan penerimaan anda. JIM cuma keluarkan surat makluman bahawa bankrap sudah membuat penyelesaian penuh.

I dah dapat hearing date akhir bulan ini. Just tunggu untuk hearing. Its very easy to be discharged. As you mentioned just be calm and whatever information you need can ask from High Court counter and your JIM officer. But some officers in JIM are not helpful at all. After receiving payment they just keep quiet. In my case, the officer is really helpful in every single work.

I attended court hearing yesterday. Successfully discharged. The court people and insolvency lawyer are so helpful even though I did not appoint any lawyer to represent me.

Just attended the hearing at room 1 and insolvency lawyer explained to court everything. They did not ask me anything. Then finally I was being asked to go to 2nd floor and get the 'perintah draft.' After court signed the document and asked me to go the library over there and type the original copy. Then after paying RM5 fee, I brought back the document to the court to sign again. You will get 3 copies. 1 for bank, 1 for Insolvency and 1 for us. That's all. Very easy job.

After the court process is completed, I went to the Insolvency on the same day and submitted a discharge letter. The insolvency officer said need to wait 48 hours for the Immigration Department to update their system and asked me to come and collect insolvency discharge letter next Monday.
