Commonly known as the Jabatan Kehakiman Syariah Sarawak in Malay.
Syariah Court (Mahkamah Syariah) was established in 1978 under the Undang-undang (Pemerbadanan) Majlis Islam Sarawak to ensure propriety and legality in the administration of justice and working of the Courts in accordance with the Syariah Islamic laws.
On March 1, 1985, Undang-undang Mahkamah Syariah Sarawak Order 1985 came into force.
Sarawak Syariah Judiciary Department was established on October 2, 1990 as a separate department from the Sarawak Islamic Religious Department. Its objective is to hear and decide on civil cases involving divorce and matrimony, civil and property claims, guardianship of infants and inheritance of Muslims.
On May 14, 1991, six ordinances were passed by the Sarawak State Assembly. Since 1991, two rules and regulations were also passed by Sarawak Islamic Religious Council (Malay: Majlis Islam Sarawak
) have been enforced and implemented by the State.

* Kaedah-Kaedah Prosiding Suami Isteri, 1992.
On September 1, 1992, the six ordinances have been gazetted and implemented. In December 2001, the Syariah Court Ordinance 1991 (Malay: Ordinan Mahkamah Syariah 1991
) has been repealed by the Sarawak Syariah Courts Ordinance 2001 which came into force on December 1, 2004.
