My company notice of termination for executive is 8 weeks (56days).
One of my account executive tender resignation on 10 Jan 2011. She wants to offset annual leave balance 6 days on the notice.
Therefore, my calculation will based on 56days - 6days (AL) = 50 days,
last day will be 28 Feb 2011. However, she insist not fair because company deducted AL on her rest day & off day. She went to labor office & they told her cant deduct AL for rest day & off day.
I need advise on whether the notice of termination calculate based on working day or regards of any rest day or off day. From my understanding, 1 week = 7 days , therefore annual leave offset can be deduct regardless of any rest day or off day.
