Compulsory Leave

I would like to enquire. Does an employer have the right to force employees to take compulsory annual leave or unpaid leave fpr the coming festive season. Furthermore, the employer does not care if the employee does celebrate the celebration. Do we, as employees have our right to say no, or just follow, or can we inform Jabatan Buruh about this? Thank you.

Dear Lily,

No employer has the right to force employees to take compulsory annual leave or unpaid leave for any reason at all.  Employees have their right to say no and if the company insists, employees can report this matter to Jabatan Buruh.

However there are companies who have collective agreements or documented in writting declaring such leave in advance at the beginning of every year and such arrangement is aggreed by employees.  You should check if you company has this prior arrangement earlier.
